Although some of the information is broadly applicable to US practice, this is probably a much more useful reference if you practice in England. Wish there were a US equivalent of this book.

This book contains verbatim case decisions from Supreme Court cases, District level cases and Appellate court cases. Each case is followed by a detailed comment section written by the editors which explains in plain English what the Justices are talking about. All the way from the First Amendment and Marketplace of Ideas theory to broadcast regulation, this book covers all major cases that have developed media law into the beast it is today. Good for the classroom, but better without a time limit.

This is not a hands-on, how-to book

For anyone wishing to get a better understanding of the big picture involved with mediation and arbitration, specifically in the realm of employment disputes, then this book is very helpful. If you are looking for a hands-on guide to help you learn to mediate or arbitrate, then this would not be the book for you. This book is not without merit, but the potential reader needs to think about what he or she needs.

The authors walk the reader through the arbitration and mediation movement in business and government. They discuss the case law behind it (in which the courts agreed to honor the findings of arbitration) as well as the legislation that is geared towards empowering this movement. A reader of this book would have a firm understanding of the organizations involved as well as the important cases and documents (like the Protocol).

The book was interesting in watching the change and resistance. Seeing a true alternative to expensive, prolonged litigation is hopeful, yet the authors aren't merely painting an overly rosy picture. They do point out the resistance and the possible trouble (such as problems of due process).

Even though the book was not what I originally thought, it was a good read as I found the progress of this movement interesting. However, if you are looking for a how-to book, then this one will not get you where you need to go.

A big overblown book

There must be some kind of agreement between the authors and the publishers at Carolina Academic Press to restrict the use of this book to law schools only. I had to borrow a copy to develop my undergrad course. They worship the book like it was golden or something over at Duke Law, and I don't know how popular it is at other places, but readers might want to check out the cheaper National Security and Military Law in a Nutshell or the Stephen Dycus textbook. There really aren't any good books on the subject. Everything you'd expect to find, and more, is here, however. The most original piece is chapter 2 on theoretical frameworks that the authors have come up with for classifying NS law (balance of power, collective security, world federalism, functionalism, and incentive theory). The rest is all pretty much a straightforward casebook. Several early chapters address the law of war, and OPLAW is also covered. Terrorism, crimes against humanity, and arms control are covered in some of the middle chapters, but those looking for in-depth analysis of peacekeeping operations should probably look elsewhere. I found a few of the latter chapters interesting, like those on intelligence, technology, and homeland security, but there were many chapters I didn't find at all useful, such as Chapters 14 (Law of the Sea), 15 (Outer Space Law), and 32 (Environmental Law). These are specialized areas of law which for my taste only involves an occasional criminal justice interest, such as how CJ is sometimes interested in piracy and/or maritime law as an example of customary law, outer space law as an example of treaty law, and environmental law as a way to learn about state, corporate, or white collar crime. Also less useful to me were Chapters 16 (Powers of Congress), 17 (Powers of President), 18 (Treaties), and 19 (Lawyers). With the exception of chapter 19 (which is career advice on how to become a national security lawyer), the others constitute the kind of emphasis which would be found in a Political Science Department, and indeed, most syllabi for such courses reflect use of the national security topic to accomplish the learning of political science insights into the basic workings of government. Also less useful to me were Chapters 21 (Domestic Terrorism), 22 (Secrecy), 23 (Freedom of Expression), 24 (Fourth & Fifth Amendment concerns), 25 (Espionage), 26 (Immigration Law), and 30 (FEMA). It's not that these topics are unimportant, but what you need to know about them are touched on elsewhere in other chapters, and these chapters are not that well-developed or well-integrated with the book. For example, chapter 21 on domestic terrorism is less than ten pages long, and probably does not technically qualify as a textbook chapter. The other chapters are either like that, consist of the contributor talking about war stories from their career, or are an extended legal brief of one or two court cases. Students should understand that in the areas of national security law and/or the international law of conflict management, there are few matters which are settled or definitive, and that controversial yet legitimate points of view exist.

The tittle is somewhat misleading

[...] After reading the book, (BTW, I bought it nearly one year ago) I realized it doesn't provide detailed solutions that might help us do-it-yourself folks to prepare tax returns, if, for instance, you're a Security trader.
The book, however, is a very good start where one may find a quite complete education on tax and estate planning, and where one may find further info. It provides many real life court cases, involving tax filings, with comments. [...] this is not a "how-to" book. For instance, it doesn't tell me how to complete Form 3115 line by line, rather it explains the purpose of the Form and the key points one must know about the Form.
The number of issues covered in the book may be more than what one needs to know. All in all, it is a very good text for those who care to know more about their money and taxes, and the nasty surprises that IRS has in store for the unprepared.

Planned Giving Workbook
By Ronald R. Jordan and Kathelyn L. Quynn
John Wiley & Sons, Inc. 2002

Reviewed by:

Norman Olshansky, President

The Planned Giving Workbook is a compilation of model documents, which are used in the course of conducting a planned giving program.

There are 425 documents presented in the workbook and/or within the CD-ROM, which comes with the publication. The documents are classified under 7 categories.
Marketing
Agreements
Correspondence
Administrative Documents
Exhibits
Presentations
Tax and IRS Documents

The documents are presented in a way that allows the reader/user to adapt them to their own program. While there is a lot of repetition of language, the book and especially the CD-ROM, can be helpful to those who are beginning or are new to planned giving. The documents provide templates for forms and other instruments, which should be in every planned giving professional's arsenal.

The authors properly note that all of the documents need to be reviewed and updated from a legal, tax and "calculation of rates" perspective. Most of the documents were prepared prior to 2001 and therefore do not reflect the most recent changes and updates which have occurred since that time.

The CD-ROM is the most valuable component of the workbook. There is also a very good section in the book that reviews how to prepare documents and outlines what are the most important components of a good document. That section relates more to writing skills rather than charitable giving content.

The title of the book is somewhat misleading since it is not a publication that deals with the totality of Planned Giving but rather one aspect.........the .development of documents used in the execution of a planned giving program. The book has a useful index and the CD is easy to use. This publication and CD-ROM should be seen more as a reference resource for ongoing use, rather than as a primer on planned giving.

Why I gave it three stars:

This book is excellent if you are a financial/advisor/accountant/tax person or like me getting ready for the CPA exam and preparing to attend a Masters in Taxation. This book is well done and worth the read.

This book is a waste of time if you are an ordinary person earning less than $150,000 a year. The examples are around an income of $500,000 per year and the lowest example used $175,000 per year. That is not most people.

You will learn a lot but this book speaks to those that have tax problems not income problems and most Americans (including me) have income problems.

Like many new business owners, i am starting a business in florida and have been overwelmed with the rules and laws as it applies to what i need to do, when i need to do it and how to do it.

This book has chapters dealing with choosing your type of business, naming the business, business licenses, insurance, health and safety codes, employment laws, contract laws, payment and collections, advertising, book keeping and accounting, federal taxes, state taxes, out-of-state taxes, selling company stock, etc.

The only reason i didnt give this book a 5 star rating was because of the business forms. I purchased a similiar book from SphinxLegal called "Incorporate in Florida" and that book covered subject matter step-by-step, then referenced a template in the back of the book and explained how to complete that template and when to complete it. So with regards to incorporating my business, i knew what paperwork to file, how to file it, when to file it, how to complete the paperwork, what paperwork to keep etc. It was written very precise, step by step.

But, this particular SPhinxLegal book about starting a business in Florida isnt as detailed. It provides some business forms in the back of the book. But, it didnt provide the step by step instructions for using them, when to use them, how to use them etc. Also the forms werent as complete. For example, it doesnt have a contractor agreement contract or vendor agreement contract or service provide contract or employee application form or examples of basic company policies that are needed for Labor or HR issues discussed int he book.

The book is great for understanding the law and operating a business. but, it doesnt go far enough in providing materials to help you accomplish this. It does reference some organizations that can help you.

Overall, this is a must read! But, it wont be a complete source for success, you will need to get another book or two to expand your understanding of specific areas.
