<br />The author does a good job explaining how to file your own bankruptcy "pro se" (which means you are your own attorney and responsible for finding the answers to your own legal questions.)

<br />At the time the 13th edition was printed, the author didn't know if any of the state bankruptcy courts would grant an indigent filer relief from the bankruptcy filing fee. This is because there was a difference between the federal agency that created the exemption document and the agency that says such requests can be granted. Apparently, this difference of opinion has since been resolved. In my state, Washington, the judge did grant me exemption from filing the court fee, a savings of over [...].

<br />My bankruptcy was a pretty straightforward chapter 7, even though I had taken out a business license as a sole proprietor. As I had no clients and no business income, I could go ahead and file as an individual.
<br />
<br />The author commends the reader for having taken charge of their financial crisis and having made the difficult decision to file for bankruptcy. It would also have been helpful if he'd included a few helpful tips on emotional and mental preparation. For example, people under stress tend to forget common sense advice like: get enough sleep, exercise, and healthy food. Organize all your financial records in a quiet and neat environment, etc. Write down what you've done and what you need to accomplish. And so forth.

<br />In my case, because I could have been better organized, I ended up paying two times an amendment fee because I forgot to include all creditors on my mailing matrix and other related forms.
<br />
<br />(As a side note, many credit card companies own their own credit collections agencies with completely different names. To be on the safe side, list both the original creditor and the "collection agency" that they supposedly "sold" the debt to in your bankruptcy forms. However, when totaling the debt, do not count the same amount twice. On your mailing matrix, include both the original creditor and any collection agencies they have sold their debt to. This will cover your rear end. If you list only the collection agency and not the original creditor, you might be responsible for paying off the debt because the original creditor wasn't listed in your bankruptcy forms.)

<br />Student loans are usually not discharged but you should go ahead and list them anyway so the judge knows your total debt load.
<br />
<br />Most filers choose to hire an attorney. I was one of three people who chose to go "pro se" out of over 30 filers. That really surprised me. My meeting with the trustee lasted less than five minutes.
<br />
<br />Just because someone goes with an attorney doesn't mean that attorney will be complete and thorough. I witnessed two attorneys who did not properly prepare their clients for potential questions the trustee asked, all of which are described in this book in a special listing. In my case, the trustee did not ask all the questions listed in the book but I was sure glad the author listed them so I could be prepared in case he did choose to ask them. Did those people get their money's worth? I don't know.
<br />
<br />The creditor's meeting is when you can tell the trustee if there have been any changes since you first filed for bankruptcy. Since this meeting is recorded now is the time to tell them. In my case, I reported assets I had failed to list (hobby supplies, etc.), assets that had been stolen from my home this month, and a car I no longer owned as it had been auctioned off by a towing company.

<br />The two biggest reasons people file for bankruptcy are medically related and poor credit card usage. Both those reasons fit my profile. (Actually, I was very good at using a credit card as I remember charging them to the limit.) I cut up all my credit cards and now use only my debit card, cash, or checks. I now have a financial budget and feel like a load has been lifted off my shoulders.
<br />
<br />The only reason I have for repairing my credit rating is if I choose to buy a house. At this time I don't have any plans for doing so. However, for those who do want to improve their credit score, your best bet is to see if your local credit union or bank will give you a secured credit card, which will only allow you to "charge" amounts that you have placed in a special account tied to the card. It is a combinations debit and credit card. You can only "charge" what is in your secured account but you get the protection and benefits of a credit card.

<br />The new law states that filers must take a pre and post budget class. These cost money in Washington state.
<br />
<br />If you choose to go "pro se" but hire a typist to prepare your documents, you are still responsible for all the information contained in the forms.
<br />
<br />Beware that your filing is public knowledge. I was surprised at the number of predatory lenders that sent me mail immediately after I filed. There was also one attorney who sent me a solicitation letter. <br />Well, I missed the boat on this one. I'd hoped the 2005 12th edition would cover the bankruptcy law changes in some detail, but nope-- this one still covers the old laws. If you're thinking about filing for bankruptcy now, you will likely be better off waiting for Elias' new one, he New Bankruptcy: Will It Work for You? (Nolo, 2006).At this point, it really only has value as an archival document, or something you pick up for background reading while waiting for the new book (after all, not everything in bankruptcy law has changed; you'll still get some valuable info out of this).

<br />The book does an excellent job of explaining why, in general, you don't really need a lawyer to file Chapter 7. Elias etc. go through the forms line-by-line, with copious explanation and recommendations of when you will need a lawyer based on your answers to a number of the questions.

<br />John Fox obviously loves the FairTax. The FairTax does all those things and more, repealing the income tax, employee taxes, corporate taxes and more while fully funding the US government. Everyone also gets a monthly rebate so noone pays any tax at all up to the poverty level.

<br />Fox says the U.S. would have a stronger economy without these provisions. He suggests doing away with all but the most essential special relief provisions, and implementing a simpler tax code that would reduce taxes for all brackets.

There in lies the limitation of this great book. You may have to refer to the other tax guides if your particular situation is too unique. <p>But the conciseness and focussed approach was extremely helpful in clarifying a lot of points for me. I had tried reading several of the bigger guides (with three times as many pages as this book) and gotten confused because it was too much information. So when I saw the Nolo guide, I was pleasantly surprised that every topic in the book was relevant to me as a small business owner! It was perfect for my needs. I now started understanding the very same topics I had so much difficulty following in the other books. For example - I was trying to research the differences between S Corporations and LLCs. When I opened this Nolo guide, I went straight to the chapter on LLCs and read the section - Comparing LLCs with Other Entities. In one sentence I knew the difference between these two entities! According to the book, the basic difference being that you can allocate income and expenses disproportionately (to share ownership) in an LLC but not in a S Corporation! Wow! <br />When you're in the savings/growing mode you're in a whole different situation than you're in when you're having to withdraw and/or live off your account. Going from one to the other requires a major change in strategy and, more important, a MAJOR change in mindset and, often, life style.
<br />
<br />You're confronted with a whole new set of regulations, whether the reason for the change is retirement, inheriting an account, etc. The biggest change in mindset is that instead of the pleasant pre-retirement situation of watching the money accumulate, you have to recognize that you're now going to be watching it DECLINE. And unless you've got a tremendously more than sufficient account, you're going to have to live with the knowledge that you could outlive the account, possibly due to your own mistakes, some of which this book can help you avoid.

<br />Four years ago I was confronted with making this shift a whole lot sooner than I'd planned, and with getting control of my retirement accounts under conditions where I had little help. Without the previous edition of this NOLO book, I would have been totally lost and probably made serious mistakes.
<br />
<br />Now, one caveat: This book does not tell you how to MANAGE your withdrawals and account so as to produce INCOME; as one should expect from NOLO press as a LEGAL advice publishing house, it deals with the nuts, bolts, traps and hazards of the PROCESS of getting the money out.

<br />In my situation I also found that there is not a whole lot of good material out there on the subject of managing your money and account IN the WITHDRAWAL stage, and this subject is affecting more and more people, as the country shifts from defined benefit (pensions) plans to plans like 401Ks and IRAs that place the job of investing and managing on the individual.
<br />
<br />It is a whole lot more complex, risky, and stressful than most people realize, especially considering the general abysmal education (lack of) even young people receive on the subject, let alone people my age who were raised to count on pensions, etc. (And thank goodness for Social Security, which while far from adequate, can still supply a firm base of about 30 to 50% of a retirement income; although that's another issue)

<br />So I recommend this book as essential for the basic procedures, but you will also need additional information on how to manage your income account(s). Personally, in addition to a good fee based financial planner, I found invaluable help from folks who have actually been doing the job for years, especially in the forums of Morningstar, for example. But you have to be on constant alert for scamsters and the whole "how to be a billionaire" publishing crowd. You're going to have to invest some serious time and effort in educating yourself for a the whole new job of retirement, and this book is an excellent place to start, preferably BEFORE you actually have to start TAKING YOUR MONEY OUT.<I>IRA's, 401(k)s & Other Retirement Plans</I>, by financial specialists Twila Slesnick and John C. Suttle, is a solid self-help legal look at a critical back-end issue that most of us blissfully ignore until we absolutely must confront it. The authors themselves admit it is not a compelling page-turner, but rather a comprehensive resource that at some point should prove indispensable to everyone with a retirement plan. They describe the various plans available--including Roth IRAs, to which an entire chapter is devoted--focusing on distribution rules, associated taxes, and potential penalties. They offer details on early distributions used to pay higher-education expenses or health-insurance premiums (which are not subject to taxes, under certain explicit conditions), distributions you must take during your lifetime (when they begin, how they're computed, what happens if your beneficiary changes), and distributions made after an account holder dies (largely concentrating on administrative procedures that could help you avoid unnecessary financial loss). Coase arrived at a simple explanation for institutions: transaction costs. In 1937 Coase argued that organizations exist because of high transaction costs, or what he referred to as market costs. This 1937 article became chapter two. It also became the basis for the modern theory of the firm, as developed by Williamson, Demsetz, Fama, and many others.

<br />Coasean economics is important because it pushes us to make fair and realistic comparisons between private and public institutions. In 1959 Coase published an article on the Federal Communications Commission which demonstrated that market imperfections do not automatically imply the need for government regulation. Transaction costs make markets imperfect, but government suffers from its own imperfections. In 1969 Harold Demsetz explained the Coasean approach to institutional analysis in his "Institutions and Efficiency, another Viewpoint". Coase's opponents are guilty of committing the Nirvana Fallacy. Economists used to condemn markets for failing to deliver ideal conditions. Those who compare real imperfect markets to an idealized perfect government will always "prove" the need for government regulation. In reality, the nirvana of perfect government never exists, so the need for governmental intervention is always questionable.

<br />Unfortunately, this 1959 article did not make it into this book. Instead, Coase used his 1960 follow up paper "The Problem of Social Cost" (chapter five) to explain his ideas about law and economics. Chapter five explains "The Coase Theorem" and "The Invariance Proposition". The 1960 paper on social costs is an outgrowth of an informal debate between Coase and Milton Friedman. This is a rare instance where Friedman admitted defeat. Given Friedman's talent for debate, Coase's victory is not a small matter. Having proven his point to the satisfaction of the Chicago economics faculty, Coase was able to join this faculty and edit The Journal of Law and Economics. Not bad for an informal after-dinner debate.

<br />The reprinting of the Problem of Social Cost is important because so many economists misconstrue the Coase Theorem. Contrary to what many believe, Coase does not assume that transaction costs are zero. The idea of zero transaction costs is just a thought experiment. Coase saw little value in thought experiments. The real message from Coase is that we should focus on real examples where transaction costs are positive and vary. Good institutions are the ones that reduce transaction costs to a minimal level. Coase explains his position further in chapter six: notes on the problem of social cost. It is also important to guard against George Stigler's misinterpretation of Coase. The idea that all institutions are imperfect does not imply that we arrive at the least imperfect institutions.

<br />The Marginal Cost Controversy (Chapter Four) and the Lighthouse in Economics (chapter seven) are also notable. Coase demonstrated that Abba Lerner and Harold Hotelling were wrong about the need for government to subsidize firms with declining average costs. Besting Lerner and Hotelling is no small feat. In chapter seven Coase took on none other than John Stuart Mill. It turns out that lighthouses are not necessarily public goods. History and common sense show that entrepreneurs can supply lighthouses for profit.

<br />The Firm, the Market, and the Law is brilliant, but often misunderstood. This is hard to explain because it is highly readable and thought provoking. Some of its points are simple, others are subtle, but they are all well reasoned. Most of the misunderstandings about this book seem to derive from the fact that some people judge Coasean economics based on what they have heard, rather than from reading this book. While I do not agree with everything in this book, reading it (and re-reading it) has made me a better economist. All social scientists and legal scholars could benefit from reading The Firm, the Market, and the Law, if they have not read it already.02261110164002008-03-05The Brilliance of Ronald Coase...Ronald Coase is a fantastic economist. He writes with great lucidity and a confidence which suggests to the reader that his arguments "fall into the category of truths which can be deemed self-evident" (page 1). Coase's principal aim in these essays is to correct what he believes to be the flaws of mainstream economic theory. In the process of doing so, he asks some remarkably novel and challenging questions, but in the end fails to pursue them consistently, arriving at conclusions which employ the same assumptions by those whom he is trying to refute.
<br />
<br />The book consists of seven essays. Very briefly, the first essay is an introduction in which Coase describes his economic outlook while introducing the concepts contained in each of the following essays. The remaining six essays can be divided up as follows. Chapters two and three contain discussions of the firm. The second essay is the highly influential "The Nature of the Firm" essay while the third essay applies these arguments to a general research proposal on industrial organization. Chapter four and seven are essays which can be described as historical. Chapter four summarizes and contributes to the "marginal cost controversy." For those with little exposure to this issue, this essay can be passed over. Chapter seven is the famous "The Lighthouse in Economics" which challenges the public goods argument by showing that the lighthous has historically been provided by private companies. The remaining two chapters contain arguments and notes on what has come to be called "The Coase Theorem." Chapter five is the actual essay "The Problem of Social Cost" and chapter six contains a series of replies to various criticisms that have been directed at the arguments presented in "The Problem of Social Cost" essay.

<br />Clearly, the best aricles in this book are chapters two and five, "The Nature of the Firm" and "The Problem of Social Cost". As I mentioned earlier, Coase begins his analysis by asking a very novel and challenging question: If the price system works itself, as is conventionally taught, then why do we see firms? His answer is that there are costs to conducting transactions through the market. The two examples he gives in various forms are:

<br />1. discovering what the relevant prices are, since outside equilibrium the relevant prices are not known.
<br />
<br />2. The costs of negotiating and concluding contracts.
<br />
<br />To my disappointment, Coase inexplicably spends the rest of the essay extending the example of the costs of contractual arrangements. Now this is an important problem, but until the question of relevant prices is resolved, the problem of executing costly contracts seems to be almost insuperable because if we still have no way of discovering what the relevant prices are, then how can we measure the degree of costs involved in "negotiating and concluding contracts" (page 38)?

<br />I would have liked to see Coase concentrate his remarkable intellectual abilities on the first problem; namely, that of disovering what the relevant prices are. He mentions this problem just once, and then omits it from all subsequent discussions of costs and market transactions. I cannot make sense of this.

<br />This problem is carried into his other famous essay "The Problem of Social Cost". Now the economic analysis contained in this essay is both rigorous and logically consistent. Given certain prices, and given a world in which transaction costs are absent, it would seem superfluous to assign rights because they would simply be re-negotiated in a way which maximizes the social product. This world is a world of equilibrium, and in such a world we can presume that the relevant prices are known. What I like about this argument is that it demonstrates to the advocates of this model (equilibrium) that economists cannot simultaneously present theories of perfect competition and market failure. In a world of perfect competition, rights will be arranged in a way consistent with the maximization of the social product. It does not make any sense to speak of market failire in conditions of perfect equilibrium. We can use Coase's analysis and say to economists:

<br />"The nature of the choice is clear: [perfect competition] or [market failure]. What answer should be given is, of course, not clear unless we know the value of what is obtained as well as teh value of what is sacrificed to obtain it" (page 96).
<br />
<br />But when Coase does admit the existence of transaction costs into the analysis, he falls into the same error of assuming that the relevant prices are still known in such a world. He writes:

<br />"In earlier sections, when dealing with the problem of the rearrangement of legal rights through the market, I argued that such a rearrangement would be made through the market whenever this would lead to an increase in the value of production. But this assumed costless market transactions. Once the costs of carrying out market transactions are taken into account, it is clear that such a rearrangement of rights will only be undertaken when the increase in the value of production consequent upon the rearrangement is greater than the costs which would be involved in bringing it about" (page 115).

<br />This argument, while laudable in its emphasis on transaction costs, still begs the question. We first must know what the relevant prices are before we can compare the relative advantages of alternative sets of rights. I think Coase's argument would be strengthened considerably once these considerations are brought into clearer light. To my knowledge, this observation has yet to be made. Before we can speak of transaction "costs", it behooves us to know, as Coase recognized, what the relevant prices are. It covers a lot of topics in an organized manner, giving useable advice and not just concepts.
